After the judicial hearing earlier in 2011 due to mis-sellings on PPI loans by banks, the number of claims to the Financial Ombudsman Services (FOS) continues to grow day by day.

Just recently, the FOS has stated that they are receiving over 1,000 claims per week, and see no letting up any time soon on these claims. The major reason for the claims by consumers is due to the fact that many consumers are being sent rejection letter after rejection letter on their claims, by their lender; therefore, consumers are forced to go through the FOS to file their claim against banks.

Many consumers are missing out on payouts due to these mis-sellings, mainly because they are unaware and do not understand the process of filing a claim to the FOS.

Many claims for mis-sellings are totalling over 2,000 pounds, especially in those cases where consumers have taken out the single-premium PPI insurance policy with their lenders.

Although not all claims are eligible to go to the FOS, consumers might still be able to obtain a refund. If you have tried to file a claim and failed, try contacting a claims company to help assist you in obtaining your refund today.

PPI News

In the last six years, you might have taken out a loan. If you did then you probably had a PPI tacked onto your policy without it being discussed with you. This was common for lenders to do; they just assumed that their customers wanted the insurance. The lenders didn’t look at the customer’s backgrounds or current situations to see if PPI policies were even necessary. As a result many people that did not need the insurance protection were paying the price of the PPI that was impractical for them to even have.

If this sounds familiar then you are entitled to look into making a PPI claim.

You might be entitled to a reclaim. It is up to the lender to prove that they offered the PPI to you in a fair way, if they cannot do this then it is highly likely that your claim will be approved and you will successfully get back the money you paid them back. Another plus to reclaiming you funds, is that you can also claim the interest that might have occurred had you placed that money into the bank over the years that you were paying into the PPI. So remember to check out your policy and see if you are owed funds.

Although you can obtain PPI coverage from your lender, it is not always needed.

Make sure you need the coverage before purchasing it, because it can get very expensive to obtain. However, if you do decide to purchase PPI insurance, decide on the right coverage for your needs, in order to save the most money. Many companies today are offering standalone PPI, which can protect any loans you have taken more cheaply than using your lenders’ own insurance.

There are a couple different kinds of ways PPI providers vary coverage, but there are two basic choices which the consumer must make.

First, decide on the coverage you need.

From accident/sickness, to unemployment coverage, to illness/death coverage, the more coverage purchased, the more expensive it will be. Second, you must backdate the benefits of your coverage so that you are paid for the periods prior to the normal 30 to 60 days period.

Make sure the coverage you are purchasing is necessary, and that you are not paying for double coverage. Redundancy is a theme among many individuals who purchase PPI coverage; therefore don’t fall into the trap from insurers to pay for something which you are already covered by with another policy.

In a recent judicial review, brought by BBA (principally), against the updates of the Financial Services Authority (FSA) and Financial Ombudsman Services (FOS), and the judges rejected BBA’s arguments claiming the rules were unfair because they were retrospective.

The BBA isn’t going to ask for an appeal; therefore, all the claims which were put on hold during the case are being processed. Although it might take some time, these claims will be paid out.

So, how much compensation can claimants expect to receive after this judicial holding?

The amount will depend on how many individuals come forward with valid complaints, and how many cases turn up as a result of the bank reviewing past PPI sales (even in cases the customer has not complained). The FSA estimated in 2010 that the rules increase the number of complaints to 550,000 a year, for the next five years.

Although it isn’t certain, the FSA has estimated that an individual who had been mis-sold by a lender (single-premium policy), where all costs were paid upfront, can expect 1,800 pounds. An individual who bought a policy requiring regular premiums can expect to receive about 900 pounds. If you have not filed a complaint, and feel you have been mis-sold, you can begin the claims process now.

Due to the high volume of complaints and claims which banks have been getting after the judicial hearing early in 2011, HSBC has been allotted extra time by the Financial Services Authority (FSA) to deal with the claims and complaints which they cannot keep up with, due to the millions of filings by consumers in regards to PPI insurance claims.

Mid June, 2011, the FSA allotted certain banks extra time to pay out on these claims, which are coming in by the thousands per week. Normally banks have 8 weeks to pay out, or at least reply to a claim, however, tens of thousands of claims have been put on hold (due to the court proceedings), therefore these banks have been given extra time to deal with claims which were on hold, and the claims which are currently still coming in. The new complaints which are coming in (after the judicial review hearing in April), but which are received before August 31 of 2011, must be handled by the banks within a period of 16 weeks.

Those received after (at the end of August), must be dealt within a 12 week period; and, anything after this time period banks have the normal 8 weeks to handle.

They have decided not to contact people on their own however. If you have a loan, you may want to go check the documents covering the loan to see if you were sold payment protection insurance. Millions of people in the United Kingdom were sold Payment Protection Insurance policies that they did not want or need. The FSA has won a series of legal cases against representatives of the British Banking Industry. The court cases have forced the banks to contact their customers if they have similar claims, but a consumer should not count on this happening.

The banks are waiting for a final ruling

If a consumer suspects that he has falling victim to the predatory practices of banks selling PPI Claims, he needs to file a complaint against the issuing bank. The complaint forms are made available for free by a number of consumer watchdog groups who are concerned about the ethics the banks did not follow. Britain’s High Street banks have already started acting on the ruling. Those who filed a complaint previously did not do so again. If a person has a PPI policy and did not file a complaint, he needs to take action now.

One of the bigger banks who have been charged with mis-selling customers in the UK, Lloyds Banking Group has apologized for flogging individual consumers with PPI policies, which were worthless to the consumers.

The banking group promised a large list of solutions to provide for compensating the victims of these mis-sellings, and try to resolve the damage which has been done to the banks reputation.

Lloyds, the UK’s largest PPI seller (estimated 40% market share), admitted in an interview that some of the sale proceeds for PPI insurance policies were flawed, and admitted to unfairly treating customer complaints in the past.

Lloyds has already set aside 2.3 billion pounds in order to repay consumers who were mis-sold on these claims, to cover for the loan payments and PPI insurance policies consumers did not need. Lloyds hopes that this apology will start to earn back their consumers’ trust, and rebuild the company’s stronghold in the industry. Lloyds has promised to pay back all mis-sold policies to consumers, and has promised to change their practices in the future in order to not harm consumers with these mis-sellings in the future. The apology is a start, but they must refund consumers to start rebuilding their credibility.
